1. Booking and Payment

1.1 Booking Process

To make a reservation, you must provide accurate personal and payment information. All bookings are subject to availability and confirmation.

1.2 Payment Terms

You agree to pay the car rental fare as per the applicable rates and payment schedules listed on our website at the time of booking. In addition to the rental fare, you are responsible for paying any parking charges, tolls, service tax, state tax, and other applicable fees or levies.

1.3 Security Deposit

A security deposit may be required at the time of booking or upon vehicle pickup. The deposit amount will be communicated to you and will be refunded upon return of the vehicle, subject to the terms and conditions outlined herein.

2. Cancellation and Refund Policy

2.1 Daily Rentals

• Within 24 Hours of Pickup Time: A cancellation fee of Rs. 200 or 50% of the Total Booking Amount (whichever is greater) will apply, plus a 3% processing fee on the remaining refund amount.
• At Least 24 Hours Before Pickup Time: A cancellation fee of Rs. 200 plus a 3% processing fee on the refund amount will apply.
• After Pickup Time: Cancellations will be treated as a no-show, and no refund will be provided.

2.2 Hourly Rentals

• No Refunds: All hourly rental bookings are non-refundable.

2.3 Refund Requests

Refund requests must be made within 24 hours of the scheduled departure time. Any requests made after this period will be considered for forfeiture.

3. Use of Services

3.1 Customer Responsibilities

You are responsible for using our services in accordance with these Terms and all applicable laws and regulations. You agree not to misuse our services or use them for unlawful purposes.

3.2 Liability Disclaimer

Eleven Mobility Pvt. Ltd. disclaims all warranties and representations to the fullest extent permitted by law. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services.

3.3 Service Quality

While we strive to provide high-quality services, we cannot guarantee that our services will be uninterrupted, timely, secure, or error-free.

4. Indemnity

You agree to indemnify, defend, and hold harmless Eleven Mobility Pvt. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with your use of our services or any breach of these Terms.

5. Data Collection and Privacy

5.1 Personal Information

We collect and use personal information to provide and improve our services. By using our services, you consent to the collection and use of your personal information as described in our Privacy Policy.

5.2 Data Disclosure

We may disclose your information to comply with legal requirements, protect our rights, or in accordance with our Privacy Policy.

6. Dispute Resolution

6.1 Arbitration

Any disputes arising out of or relating to these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Delhi, India, and the award shall be binding upon the parties.

6.2 Jurisdiction

The courts in Delhi, India, shall have exclusive jurisdiction over any matters arising from the use of our services.

7. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the updated Terms.

8. Call Recording and Monitoring

We may record and monitor calls made to our customer service centers for quality assurance and training purposes.

9. Vehicle Usage Policy

9.1 Speed Limit

• First Violation: Rs. 200 penalty.
• Second Violation: Rs. 500 penalty.
• Third Violation: Rs. 1000 penalty. After the third instance, booking may be canceled, and the vehicle may be reclaimed.

9.2 Traffic Violations

You are responsible for any traffic violation tickets received during your rental period. We may charge your credit/debit card for these violations.

9.3 Vehicle Modifications and Misuse

• Changing Spare Parts: A penalty of Rs. 5000 will be charged for unauthorized changes.
• Tyre Damage: Costs for tyre damage due to improper use will be charged.
• Running Vehicle in Damaged Condition: Costs for repairs will be charged.
• Unauthorized Activities: A penalty of Rs. 5000 will apply for carrying banned items or using the vehicle for commercial purposes.
• External Branding: A penalty of Rs. 5000 will be charged for unauthorized branding.
• Tampering with Devices: A penalty of Rs. 1000 plus the cost of the device will be charged.
• Water Damage: Costs for repairs due to water damage will be charged.

9.4 Document Verification

You must provide accurate personal documents. A penalty of Rs. 1000 will apply for falsified or tampered documents.

9.5 Geographical Restrictions

A penalty of Rs. 10,000 will be charged for driving into restricted areas.
